Experian Showing Negative Account After "On Record Until" Date.

Updated: Sep 14

When engaging in credit repair and debt relief, many people choose to not take action on an account if the report is scheduled to fall off your report soon anyways. However, what if the negative report continues to show after the schedule expiration date? Your Experian credit history report contains a wealth of information such as the date opened and the amount owed but some accounts contain a date labeled "on record until" which shows when the account is expected to fall off your history. Unfortunately, mistakes happen, so here's is a guide on what to do if your on-record date passes and the item is still showing on your report.

1. Ensure the Original Date is Accurate

First and foremost, verify that the original date associated with the negative account is correct. Sometimes, the date shown on your Experian report might be inaccurate, leading to confusion. Some consumers have reported the fall-off date arriving and the date disappearing from the record while the negative item remains. In this case, it may be that the original date was simply incorrect.

  • Identify the Account Type: Different types of negative information have different durations for staying on your credit report. For instance, late payments typically remain for seven years. Verify the specific timeframe for the negative information in question.

  • Calculate the Timeframe: Compare the date the negative event occurred with the current date. Ensure that the right amount of time has indeed passed since the original delinquency. If the information should have already expired, you have a valid reason to dispute it.

2. Contact Experian

Once you've confirmed that the negative information is past its "on record until" date, the next step is to contact Experian directly. Here are the steps:

  • Gather Documentation: Collect any relevant documents that support your claim, such as transaction records, payment histories, and correspondence with creditors.

  • Contact Methods: You can reach out to Experian via their online dispute center, by phone, or through mail. Provide all necessary details and documentation to support your claim.

  • Explain the Issue: Clearly explain that the negative account is still showing on your report past its expiration date. Request that Experian correct the mistake or provide clarification if there has been a misunderstanding. Be clear that you will seek further course of action is the matter is not resolved.

Note: You can follow the dispute process from DIY Credit Kit Module 6. However, for an issue like this using an online dispute form or contacting by phone should be sufficient as it is likely a clerical error that Experian would be happy to correct.

3. File a Complaint with the CFPB

If contacting Experian doesn't resolve the issue, you might want to escalate the matter by filing a complaint with the Consumer Financial Protection Bureau (CFPB). Here's why and how:

  • Why File a Complaint: The CFPB oversees financial institutions and ensures they follow fair practices. Filing a complaint can prompt a quicker response from Experian and may result in the removal of outdated negative information.

  • How to File: Visit the CFPB's website and complete their online complaint form. Provide all necessary details, including the steps you've already taken with Experian and any supporting documentation.

  • Success Stories: Many consumers have reported success and quick turnaround times in removing outdated negative information from their reports using this method.

Dealing with outdated negative information on your credit report can be frustrating, but by following these steps, you can address and resolve the issue. Always ensure your information is accurate, contact Experian directly, and don't hesitate to escalate to the CFPB if necessary. By staying proactive, you can maintain the integrity of your credit report and improve your overall credit health.
